USER AGREEMENT

This User Agreement of www.RakeBackCodes.com (“User Agreement”) sets forth the conditions and terms under which users may access and use the RakeBackCodes.com Services (“Services”).  To become a RakeBackCodes.com user, you must read and accept all of the conditions and terms set forth in this User Agreement and the separate Privacy Policy.  Any inconsistency between the RakeBackCodes.com Privacy Policy and this User Agreement is unintentional, and the User Agreement will control.  If you do not agree to be bound by the conditions and terms of this User Agreement, you may not use or access the RakeBackCodes.com services offered by this website (“Website”).  RakeBackCodes.com reserves the right to refuse service without prior notice to any user for any or no reason. 

This User Agreement may be modified at any time by RakeBackCodes.com without prior notice, by amending the terms contained within the User Agreement.  Such modifications will become effective immediately upon their posting to this page.  It is your obligation to review this User Agreement on a regular basis to inform yourself of any changes that may have been made to the User Agreement.  Your continued use of any of the RakeBackCodes.com services denotes your acceptance of any such modified terms.  

Description of Services
RakeBackCodes.com exclusively offers informational services on the topic of poker to its users, free of cost.  We do not promote, encourage or provide information on any other form of internet betting, including, but not limited to, online sports books or casinos. 

RakeBackCodes.com also offers the opportunity for members to receive a rebate of a portion of the scaled commission fee (or rake) that a third-party gaming site may collect per poker hand.  This rebate is commonly referred to as a rakeback.  For details on membership, please see FAQ.

RakeBackCodes.com reserves the right to alter the service provided at any time without notice.

Membership Eligibility
The Services are not available to persons:

As a member of RakeBackCodes.com, you acknowledge and confirm that your engagement in such activities are legal and in accordance with the laws and regulations of all jurisdictions governing the member.  Ancillary gaming laws vary by jurisdiction.  As such, members acknowledge and confirm that they understand and fully comply with any laws or regulations applicable in the jurisdictions governing them.  Members acknowledge and confirm that neither RakeBackCodes.com or its representatives can provide any warranties as to the legality of an activity in which a member chooses to engage. 

User Responsibilities
As a user and member of the Services, you are accountable for maintaining the accuracy and confidentiality of your password and account. 

As a user and member of the Services, you are fully responsible for all activities that occur under your password or account with or without your knowledge, and any misuse of your account in violation of this User Agreement or the Privacy Policy may result in the termination of your account.  In the event of any misuse, you must notify RakeBackCodes.com immediately. 

As a user and member of the Services, you acknowledge that information and material provided by third parties, including other users and members, cannot be verified by RakeBackCodes.com and RakeBackCodes.com is not in any way responsible for the Content made available and not originated by RakeBackCodes.com or its authorized agents.  RakeBackCodes.com does not guarantee the accuracy of such information and material in any way.  RakeBackCodes.com reserves the right to monitor user and member activity in order to ensure the accuracy of such information and material, but is not obligated to do so.

As a user and member of The RakeBackCodes.com Service, you will not modify or otherwise alter the content created by RakeBackCodes.com or posted by other users or members on the Website. 
  
As a user and/or member of the Service, you agree not to email or otherwise make available postings, messages, text, files, images, video or other materials (“Content”):

1) that is unauthorized or unsolicited advertising, including “junk e-mail,” “spam,” or other unsolicited promotional materials;

2) that infringes upon the intellectual property or otherwise proprietary rights of another, including, but not limited to, copyrights, patents, trademarks or trade secrets; 

3) that violates any relevant laws or regulations, including, but not limited to, criminal laws, or gaming laws; and

4) that is false, deceptive or misleading.

The use of any automated or manual devices, software or other processes to “crawl” or “spider” any web pages contained in the Website is strictly prohibited. As a user and/or member of the Service, you agree not to copy or monitor, or allow others to copy or monitor, the website or the content of the website. Furthermore, you agree not to take any action that interferes with the proper working of the website, including, but not limited to, attempting to gain unauthorized access, placing an unreasonable burden on our infrastructure, unsolicited communications, or the activation or transmission of computer viruses.

User Conduct
As a user of the Website, you agree not to use the Service in the following ways:

1) to communicate in any unlawful, libelous, abusive, obscene, discriminatory or otherwise objectionable way;

2) for any illegal purpose, including connecting from a jurisdiction where participation in online gaming is prohibited by law;

3) to misrepresent your identity, including, but not limited to, registering with an account name that differs from the name listed on your credit card;

4) to disclose, communicate or distribute content or information that you do not have the right to disclose, communicate or distribute, in any way, including in ways that infringe on the copyright, trademark, patent, trade secret or other proprietary rights of others; or

5) collect e-mail or user information for the purposes of sending unauthorized or unsolicited material to users or members. 

Licenses
RakeBackCodes.com grants to its users and/or members a limited, revocable, non-exclusive license to access the Website and its Services under the terms and conditions specified in this User Agreement.  Use of the website and its services beyond the scope granted to you by RakeBackCodes.com immediately terminates this license.   

Membership Services
Membership to RakeBackCodes.com is free.  You will receive your membership username and password from RakeBackCodes.com within one (1) to three (3) business days after filling out the RakeBackCodes.com sign up form.  Once you have been issued a username and password, you can check your personal rakeback statistics through the Website’s “Your Rake Back” feature.  Your membership provides you the ability to directly reclaim money from third-party gaming sites.  Rakeback rates are determined by the commissions authorized by the gaming sites.  Monies you receive for playing with a particular site fluctuates with these commissions.  Usually, a member will automatically receive payment of rakeback from the third party gaming sites directly and RakeBackCodes.com has no control over when this amount is paid to a member. 

The amount of rakeback a member is entitled to receive is based on the calculations made by the gaming sites on which you play and communicated to RakeBackCodes.com on a monthly basis.  In order to issue your rakeback to you, gaming sites will send us information, including: name, email, identification number, number of raked hands played, monthly rake and overall rake.  You hereby grant RakeBackCodes.com a license to view this data for the purpose of issuing your rakeback. 
RakeBackCodes.com has no ability to determine the accuracy of the gaming sites’ calculations and any dispute that may arise over the amount of rakeback to which you believe you are entitled will not involve RakeBackCodes.com.  If you believe there has been a discrepancy, notify RakeBackCodes.com within ten (10) days of distribution and we will forward you the calculations sent to us by the gaming sites.  If you believe that the calculations of the gaming site are inaccurate, consult the relevant gaming site immediately. 

Third Party Gaming Sites usually pay net rakeback to you by the 20th of the following month after the money is earned. So if you earn $50 worth of rakeback on hands played between January 1st to the 31st, you will receive that $50 by the 20th of February. All rakeback rates will be clearly displayed on the Website and can change without notice. It is your duty to inform yourself of the applicable rakeback rates. If your rakeback balance is below $25.00, you will not receive a payment until your balance is above $25.00. A balance below $25.00 will be rolled over to the following month until your rakeback balance is above $25.00. In order to receive payment you must cash out your rakeback through the "Cash Out" feature you will need to accumulate over $25.00 into the "Rollover" account in order to be eligible for cash out. You can only cash out rakeback earned from the "Rollover" account. The "Cash Out" feature will only be active from the 8th to the 15th and will allow you to cash out your "RollOver" amount if it is above $25.00.

A negative balance on your account will be carried over to the following month and it will be displayed as “Roll Over” in the RakeBackCodes.com reporting system. 

Gaming sites generally have the right to withhold rakeback payments in the event of violations of the Gaming sites’ Terms of Use or any unlawful activity.  RakeBackCodes.com has no obligation to pay rakeback to you if such a situation occurs. 

RakeBackCodes.com will cease payment to our members, in the event of (i) changes or amendments made to our agreements with gaming sites; (ii) the method by which a gaming site distributes rakeback; (iii) the percentage of rakeback a gaming site may give to us; or (iv) changes or amendments in the laws pertaining to the regulation of gaming.

Communication by RakeBackCodes.com
RakeBackCodes.com may from time to time communicate with you and other users and/or members via email and other methods of communication for purposes, including, but not limited to:  

1) updating users and/or members as to new, deleted or modified features and capabilities of the website;

2) requesting the verification of information directly related to your account;

3) providing rakeback to members; or

3) notifying users and members of any offers provided or approved by RakeBackCodes.com.

Links to Third Party Sites
The website contains links to third party websites.  RakeBackCodes.com does not guarantee the accuracy, integrity or quality of the content of this information or the sites of these third parties.  The content contained in the sites of third parties is governed by the User Agreement of those sites and we encourage you to consult their User Agreement when dealing with third party websites.  RakeBackCodes.com is not responsible for the contents posted or activities that occur on these other websites.  Because a link to another website appears on our Website does not mean we endorse that website or are affiliated with them in any manner.

In order to take part as a member of RakeBackCodes.com, it may be necessary to open a new account with a gaming website.  In order to do this, a member cannot have an existing real money account with the particular gaming website. 

Termination
RakeBackCodes.com may at any time, with or without cause, terminate your account or an account linked by an IP Address or Mac Address to any account that failed to comply with this User Agreement for any of the following reasons, including, but not limited to:

1) violations or breaches of this User Agreement or other RakeBackCodes.com agreements;

2) requests by the government, law enforcement or any other regulatory agencies;

3) a request by you to terminate your account;

4) any technical difficulties, including, but not limited to, the distribution, in any manner, of computer-related viruses, spyware or malware; and

5) your inactivity as determined by RakeBackCodes.com. 

These reasons for termination are examples only, and RakeBackCodes.com’s right to terminate accounts will not be limited to these reasons.  As a user and/or member of RakeBackCodes.com, you agree that RakeBackCodes.com has complete authority to terminate accounts, and any such termination may result in the denial of further access to your account and any related benefits conferred to you as a consequence of membership.  RakeBackCodes.com’s decisions regarding controversies or disputes will be final and binding in all respects. 

Indemnification
By accepting this User Agreement, you agree to indemnify and otherwise hold RakeBackCodes.com, and any of its affiliates, agents, employees, subsidiaries and other partners from any direct, indirect, incidental, special, consequential or exemplary damages resulting from: 1) your use of the Services and Website, 2) unauthorized access to or alteration of your communications with or through the Website, 3) any content, links, advertisements, site malfunctions, miss-directions or any other events that may cause harm mentally, physically or to property, or 4) any other matter relating to the Services. 

All content presented on this Website is for informational purposes only. RakeBackCodes.com does not recommend or endorse any specific opinions, products, procedures, tests or other information that may be mentioned in the content of this Website.

Warranties
RakeBackCodes.com expressly disclaims any and all warranties, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.  No further communications between you and RakeBackCodes.com will create additional warranties.  Any use of this website is done at the risk and discretion of the users and members, and RakeBackCodes.com expressly disclaims any and all warranties related to any and all damage resulting from the use of this website.  RakeBackCodes.com makes no warranty that the RakeBackCodes.com Service will serve your needs and expectation, or will continue uninterrupted or error-free.

RakeBackCodes.com will not be liable to users, members or any third party, for the approval or termination of any account or the denial or approval of access to the Services.

RakeBackCodes.com will not be liable for any losses or damages arising from the failure of users or members to comply with this User Agreement.  RakeBackCodes.com is not responsible for lost profits resulting from use of the Services.  If a gaming website defaults on its agreement to pay rakeback directly to you or indirectly through RakeBackCodes.com, RakeBackCodes will not be liable for any outstanding rakeback owed to you. 

RakeBackCodes.com will not be liable for errors, omissions, or inaccuracies in the content of the Website.

To notify RakeBackCodes.com of infringing or unlawful content, please provide the Copyright Agent of RakeBackCodes.com with the following information:

RakeBackCodes.com takes such notices very seriously.  We will evaluate the provided notice and, if appropriate based on our sole discretion, remove the content or disable access to the content. Based on our judgment, we may notify the source of the content of your complaint and our actions in response to your complaint. We reserve the right in our sole discretion to restore such content if the source of such content provides evidence that the content should not have been removed.  We encourage you to seek the advice of an independent attorney before filing an intellectual property notice or responding to a notice filed by another user.

Propriety Rights
